1.  Accept these terms

These terms govern your use of cognevity.com.au. By using this website, you accept them. If you don't accept them, please don't use the site.

In these terms, 'we', 'us' and 'our' mean Cognevity Pty Ltd (ABN 25 675 131 665). 'You' means anyone using this website.

These terms work alongside our Privacy Policy and Website Disclaimer. If you become a coaching client, our Coaching Services Agreement governs those services — see Section 7.

2.  Use this website

You need to be 18 or over to use this website or purchase our services. Our services are for adults only. We don’t knowingly collect information from anyone under 18. If you’re under 18, please don’t submit your details through this website. If you believe we may hold information about someone under 18, please contact us and we’ll delete it.

Please use this site lawfully and respectfully. Don’t try to interfere with how it works, gain unauthorised access, or use it in a way that harms us or anyone else.

Cognevity is based in Australia and operates under Australian law. We work with clients outside Australia, except in the United States and Canada, where our services aren’t available. We don’t represent that this website or our services comply with the laws of other countries. If you’re accessing our services from outside Australia, it’s your responsibility to make sure doing so is lawful where you are.

3.  Understand this is not medical advice

Everything you’ll find here is designed to inform, empower, and support you — but it’s not medical advice. The information on this website is general in nature and isn’t a replacement for personalised guidance from your GP or healthcare team. Nothing here is intended to diagnose, treat, cure, or prevent any medical condition.

Cognevity offers education and coaching to help you understand and support your cognitive health. We don’t provide medical treatment, diagnosis, interpretation of medical test results, prescriptions, or therapy.

Before making any changes that could affect your health — including adjustments to diet, supplements, exercise, or lifestyle — please check in with a qualified medical professional who knows your personal situation.

If you are experiencing a medical emergency, call 000 or go to your nearest emergency department. Don't rely on this website.

4.  Use our content and self-assessment tools

Our blog, newsletter, and any quiz, checklist, or self-assessment tool on this website are general educational resources. They're not personal advice, they don't assess your individual health, and they don't produce a diagnosis or a clinical risk rating.

We take care to keep our content accurate and current, but research changes and errors happen. We don't warrant that the content is complete, accurate, or suitable for your circumstances.

5.  Understand that results vary

We don't guarantee any particular health or cognitive outcome. Results depend on many things, including your own circumstances, your health, and how consistently you apply what you learn.

Any client story or testimonial on this website describes one person's individual experience. It isn't a promise, a prediction, or a typical result, and it shouldn't be read as one.

6.  Book a discovery call

A discovery call is a free, no-obligation conversation about whether coaching suits you. It's general information only. We don't assess your health, give medical advice, or form a view about your cognition during that call, and nothing said in it creates a coaching relationship.

7.  Buy our services

If you engage us for coaching, our Coaching Services Agreement sets out the services, fees, cancellation terms, and refunds. Where these website terms and that Agreement differ, the Coaching Services Agreement prevails for those services.

Any refund is handled under that Agreement and in line with the Australian Consumer Law.

8.  Know your consumer rights

Our services come with guarantees under the Australian Consumer Law that can't be excluded. Nothing in these terms limits those rights.

Where the law allows us to limit our liability, our liability for a failure to meet a consumer guarantee is limited to supplying the services again, or paying the cost of having them supplied again.

9.  Limit our liability

To the extent the law allows, and subject to Section 8, we're not liable for any loss or damage arising from your use of this website or your reliance on its content — including where the site is temporarily unavailable, or where content contains an error or omission.

You use this website and its content at your own risk. This doesn't limit any liability that can't lawfully be limited, including for death or personal injury caused by our negligence, or for fraud.

10.  Respect our intellectual property

This website and its content — including text, design, layout, graphics, and the Cognevity® registered trademark — are owned by or licensed to us. Please don't reproduce, republish, distribute, or commercially exploit our content, or use it to train an AI system, without our written permission.

11.  Follow links at your own risk

This website may link to other websites for your convenience. We don't control them, we're not responsible for their content, and a link doesn't mean we endorse them. Their terms and privacy practices are their own.

12.  Protect your privacy

Our Privacy Policy explains what personal information we collect, how we hold and use it, who we share it with, and how you can access, correct, or raise a concern about it. Please read it alongside these terms.

13.  Note changes to these terms

We may update these terms from time to time. The current version is always on this website, with the date it was last updated. Where a change is significant, we'll take reasonable steps to bring it to your attention. Changes don't apply retrospectively to services you've already bought.

14.  Resolve disputes and set governing law

If you have a concern about this website or our services, please tell us at rachel@cognevity.com.au and give us a reasonable opportunity to put it right.

These terms are governed by the law of New South Wales, and we both accept the non-exclusive jurisdiction of the courts of New South Wales.

15.  Apply general terms

If any part of these terms is found to be unenforceable, that part doesn't apply and the rest continues in force.

These terms, together with our Privacy Policy and Website Disclaimer, form the whole agreement between us about your use of this website.
